The Supreme Court is set to deliver a landmark ruling today, Tuesday, November 12, on Speaker Alban Bagbin’s contentious decision to declare four parliamentary seats vacant.
The declaration, made unilaterally by the Speaker, has ignited a legal dispute, raising concerns about the extent of the Speaker’s authority and the constitutional process for determining parliamentary vacancies.
Notably, the Speaker’s counsel, Thaddeus Sory, was absent in court on Monday, November 11, and did not file the required statement of case. This absence follows objections from the Attorney-General, who questioned the legality of Sory’s ongoing representation of the Speaker, citing a lack of approval from the Public Procurement Authority.
The case, initiated by Alexander Afenyo-Markin, leader of the New Patriotic Party (NPP) parliamentary caucus, challenges Bagbin’s decision, which was issued without judicial oversight or the initiation of by-elections to fill the seats.
