Tamale High Court Orders Rerun of Kpandai Parliamentary Election

The Tamale High Court has directed the Electoral Commission (EC) to conduct a fresh parliamentary election in the Kpandai constituency within 30 days, following a successful legal challenge to the 2024 poll results.

The ruling, delivered by His Lordship Justice Emmanuel Brew Plange, stems from a petition filed by former Member of Parliament and National Democratic Congress (NDC) candidate, Daniel Nsala Wakpal, who contested the legitimacy of Matthew Nyindam’s election as MP.

Wakpal argued that the December 7, 2024 parliamentary election in Kpandai was fraught with irregularities. He cited inconsistencies on FORM 8A (Pink Sheets) in 41 out of 152 polling stations, claiming these breaches violated Regulations 32(7), 39(2), and 43 of the Public Elections Regulations, 2020 (C.I. 127). According to him, the irregularities undermined the credibility of both the voting and collation processes and materially affected the final outcome.

“The parliamentary election held in the Kpandai constituency on 7th December 2024 was not conducted in compliance with Regulations 39 of the Public Elections Regulations, 2020 (CI 127)… and the said non-compliance affected the results,” Wakpal stated in his petition. He further argued that the declaration and publication of results were similarly flawed under Regulation 43.

Wakpal sought an order nullifying the results from the 41 affected polling stations and compelling the EC to conduct a rerun.

In his judgment, Justice Plange upheld the petition, annulling the disputed results and instructing the EC to organise a new election to determine the legitimate winner of the parliamentary seat.

The rerun is expected to take place within 30 days from the date of the ruling.
