Lawyers for former Director of the National Signals Bureau (NSB), Kwabena Adu Boahene, walked out of the Accra High Court on Thursday, October 23, 2025 following the trial judge’s refusal to grant an adjournment.

The defence team, led by Samuel Atta Akyea, had informed the court that an application had been filed at the Supreme Court seeking to prohibit Justice Eugene Nyadu Nyantei from presiding over the case, alleging bias. Mr. Atta Akyea therefore requested that proceedings be suspended pending the Supreme Court’s decision.

However, the prosecution, led by Principal State Attorney Esi Dentaa Yankah, strongly opposed the request, arguing that there was no legal justification to halt the trial.

“There is no rule of law that requires proceedings to be halted so counsel for the accused can pursue an interlocutory injunction,” Ms. Yankah stated, accusing the defence of repeatedly employing delay tactics.

She further pointed out that the defence had developed a pattern of filing motions at every stage of the case to stall progress.

After listening to both parties, Justice Nyantei ruled that the filing of a prohibition application at the Supreme Court was not sufficient grounds to suspend the ongoing trial.

The ruling prompted a strong reaction from the defence, with Mr. Atta Akyea and his team walking out of the courtroom in protest.

Unfazed, the judge directed the prosecution’s second witness — the Director of Finance at the NSB — to continue her testimony. He further instructed Mr. Adu Boahene to either recall his lawyers or represent himself. The court then took a short recess.

When proceedings resumed, the former NSB Director informed the court that he had been unable to reach his legal team and appealed for an adjournment. The judge subsequently granted the request, adjourning the case to October 30, 2025, for continuation.

Kwabena Adu Boahene, his wife Angela Adjei Boateng, and two others are facing multiple charges, including stealing, money laundering involving GH¢49.1 million, willfully causing financial loss to the state, and abuse of public office.

The third accused, Mildred Donkor, has since become a prosecution witness after the Attorney-General withdrew the charges against her.
