Attorney-General appeals stay of proceedings in Hanan Abdul-Wahab trial

27

The Attorney-General has challenged a Court of Appeal decision that halted proceedings in the criminal trial of former National Food and Buffer Stock Company Chief Executive, Hanan Abdul-Wahab, and his wife, Faiza Sediu Wuni.

The appeal follows a ruling by a three-member panel of the Court of Appeal, presided over by Justice Noble Nkrumah, which granted an application filed on behalf of Abdul-Wahab by former Attorney-General Godfred Dame.

The court held that the application raised exceptional circumstances warranting a stay of proceedings. It also underscored the importance of charge sheets in criminal trials and the need for prompt resolution of challenges relating to them.

However, the Attorney-General is contesting the decision, arguing that the court erred in treating a challenge to a charge sheet as an exceptional circumstance justifying the suspension of the trial.

The prosecution is asking the appellate court to set aside the ruling and direct the High Court to resume proceedings in the case.

The outcome of the appeal will determine whether the trial can proceed while the issues surrounding the charge sheet are being contested.
