Court to rule on Sosu’s case against IGP on March 28

An Accra High Court will rule on the interlocutory injunction brought by Madina MP, Francis Xavier-Sosu, against the Inspector General of Police, Dr. George Akuffo Dampare on March 28, 2022.

The Madina MP is seeking to enforce his fundamental human rights, arguing that attempts by the Inspector General of Police, Dr. George Akuffo Dampare, to arrest him without prior notification and explanation were unlawful.

This follows a street demonstration on October 25, 2021, in his constituency against the deplorable nature of roads in the area.

He was charged with obstructing the Ayi Mensah-Kweiman-Danfa-Adoteiman and Otinibi highways, and the destruction of public property, following which the police issued a warrant for his arrest after several failed attempts to cuff him.

Mr. Xavier-Sosu is seeking a declaration that the conduct of the IGP was in breach of the standards of “fairness and reasonableness under Article 23, proper use of discretion under Article 296 and all implied rights inherent in a democracy intended to secure the freedom and dignity of man which include, the right not to be subjected to arbitrary and malicious prosecution under Article 33 (5) of the 1992 Constitution.”

He is also seeking “a declaration that the Police action violates rights to protest and demonstrations” and is asking the court to order the IGP to pay him compensation for unlawful and unwarranted breach of rights.

He insists the said demonstration was done in accordance with the Public Order Act.
